أجلت المحكمة الاقتصادية في الإسكندرية النظر في الدعوى المقامة من الفنانة المغربية بسمة بوسيل التي تتهم من خلالها سيدة بالسب والقذف والتشهير عبر مواقع التواصل الاجتماعي، وذلك لاستكمال الاطلاع على الأدلة الرقمية المرتبطة بالواقعة.

وجاء قرار التأجيل بعد طلب المحكمة تقديم مقاطع الفيديو التي أشارت بسمة إلى ظهور المتهمة خلالها، بعدما تبين أن أوراق القضية لا تتضمن المقطع الذي تستند إليه الاتهامات بشأن قيام المتهمة بتوجيه عبارات سب وقذف بحق الفنانة.
وقررت هيئة المحكمة فتح باب المرافعة مجددًا، ومنحت المجني عليها فرصة أخيرة لتقديم الأدلة الرقمية المشار إليها، لتتمكن من فحصها والتحقق من صحتها ومضمونها قبل إصدار الحكم النهائي في القضية.
الاستماع إلى المرافعات
وشهدت الجلسة الاستماع إلى مرافعات دفاع المتهمة ومحامي الفنانة بسمة بوسيل، إذ تمسك دفاع كل طرف بموقفه القانوني، في انتظار ما ستسفر عنه إجراءات الفحص للأدلة المقدمة أمام المحكمة.
تفاصيل الاتهام
وتعود تفاصيل القضية إلى البلاغ الذي تقدمت به بوسيل بعد تعرضها للإساءة عبر مواقع التواصل الاجتماعي، واتهمت سيدة باستخدام حساب إلكتروني لنشر محتوى تضمن عبارات اعتبرتها سبًا وقذفًا وتشهيرًا بها.
وبحسب ما ورد في أوراق القضية، فقد كشفت التحقيقات المدعومة بتحريات المباحث وأقوال شهود الإثبات عن قيام المتهمة، صاحبة أحد الحسابات على مواقع التواصل الاجتماعي، بنشر عبارات وألفاظ خادشة للحياء بحق المجني عليها، فضلًا عن نشر محتوى اعتُبر مسيئًا لها ويمس حياتها الخاصة.
كما تضمنت الاتهامات تعمد إزعاج بسمة بوسيل ومضايقتها، من خلال إساءة استخدام وسائل الاتصالات، ونشر محتوى إلكتروني من شأنه التأثير على سمعتها أمام الجمهور.
إحالة للمحاكمة
وبعد انتهاء التحقيقات، قررت نيابة الشؤون الاقتصادية إحالة المتهمة إلى المحاكمة أمام المحكمة الاقتصادية بالإسكندرية، باعتبارها المحكمة المختصة بنظر جرائم تقنية المعلومات والجرائم المرتبطة باستخدام وسائل التواصل الاجتماعي.
وتلقت مديرية أمن الإسكندرية إخطارًا بشأن بلاغ يتهم سيدة بالتعدي على الفنانة بسمة بوسيل عبر مواقع التواصل الاجتماعي، قبل أن تبدأ جهات التحقيق في فحص الواقعة والاستماع إلى أقوال الأطراف المعنية.
وتنتظر المحكمة في الجلسة القادمة تقديم المقاطع والمواد الرقمية محل الخلاف، باعتبارها عنصرًا أساسيًا في حسم مدى صحة الاتهامات المنسوبة إلى المتهمة، قبل إصدار قرارها النهائي في الدعوى.
The Economic Court in Alexandria has postponed the hearing in the case filed by Moroccan artist Basma Boussil, in which she accuses a woman of defamation, slander, and libel through social media, in order to complete the review of the digital evidence related to the incident.

The postponement decision came after the court requested the submission of video clips that Basma referred to, showing the accused, after it became clear that the case documents did not include the clip on which the accusations are based regarding the accused directing slanderous remarks against the artist.
The court decided to reopen the floor for arguments and granted the victim a final opportunity to present the mentioned digital evidence, so that it could be examined and verified for its authenticity and content before issuing a final ruling in the case.
Listening to the Arguments
The session witnessed the hearing of the arguments from the defense of the accused and the lawyer of artist Basma Boussil, with each party insisting on its legal position, awaiting the outcome of the examination procedures for the evidence presented before the court.
Details of the Accusation
The details of the case date back to the complaint filed by Boussil after she was subjected to abuse via social media, accusing a woman of using an electronic account to publish content that included phrases she considered defamatory, slanderous, and libelous against her.
According to what was stated in the case documents, investigations supported by police inquiries and witness statements revealed that the accused, who owns one of the accounts on social media, published indecent phrases and words against the victim, in addition to posting content deemed offensive to her and affecting her private life.
The accusations also included deliberately disturbing and harassing Basma Boussil through the misuse of communication means and publishing electronic content that could affect her reputation in front of the public.
Referral to Trial
After the investigations were completed, the Economic Prosecution decided to refer the accused to trial before the Economic Court in Alexandria, as it is the competent court to consider information technology crimes and crimes related to the use of social media.
The Alexandria Security Directorate received a notification regarding a complaint accusing a woman of assaulting artist Basma Boussil via social media, before the investigative authorities began examining the incident and listening to the statements of the concerned parties.
The court is awaiting the submission of the disputed clips and digital materials in the next session, as they are a key element in determining the validity of the accusations against the accused before issuing its final decision in the case.
